
Diane M.
Wittenberg has been a tax/pension attorney and employee benefits consultant for
almost twenty years. She has extensive experience in drafting qualified
retirement plans, welfare plans, fringe benefit programs, recordkeeping
agreements and investment management agreements. She has provided counseling to
a wide variety of clients and service providers relating to employee benefit
issues, reporting and disclosure requirements, fiduciary responsibility,
prohibited transactions, plan administration including participant loans,
distributions, rollovers and QDROs.
Diane has
drafted, reviewed and negotiated numerous QDROs and has developed QDRO
procedures, sample QDRO language, and internal processing policies for both
service providers and plan sponsors. In addition, Diane has been responsible
for "qualifying" domestic relations orders on behalf of plan
administrators.
Most recently,
Diane has proivded services to family law practicioners and their clients to draft
QDROs, review QDROs prepared by other professionals and assists with pension-related
issues.
Diane received
her B.A. and J.D. from the University of Mississippi where she was an Editor of
the Mississippi Law Journal. She also received her Masters of Law in Taxation
from Boston University where she was a member of the Boston University Journal
of Tax Law.
Diane is
admitted to practice law in Massachusetts. She is also a member of the American
and Massachusetts Bar Associations.
